RELEASE OF LIABILITY AND ASSUMPTION OF RISK: WISCONSIN RIVERSIDE RESORT CAMPGROUND & PREMISE

RISKS: I understand the dangers and risks involved with Camping at Wisconsin Riverside Resort. The risks include, but are not limited to, death, drowning, brain injury, paralysis, other serious bodily injuries, sunburn, bites, heatstroke, dehydration, burns, broken limbs, sprains and personal property damage. I understand that even if all safety precautions are followed, that these risks may still exist for me, my guests, my visitors and the minors under my supervision. I understand that there is NO LIFEGUARD ON DUTY AT ANY TIME on the premise of Wisconsin Riverside Resort.

Wisconsin Riverside Resort (WRR) is committed to the safety of its participants in our recreation and camping activities. Risks can be significantly reduced if everyone follows safety rules and instructions that are designed to protect the safety of our guests. This applies to campers, guests and visitors on premise at WRR. It is always advisable to consult a physician before undertaking any physical activity while camping, especially if the participant is pregnant, disabled, or ill.

ASSUMPTION OF RISKS: I voluntarily agree to assume the risks in Camping at WRR for myself, group members, guests, visitors and the minors under my supervision for a camping stay at WRR. I realize that myself, camper guests, visitors or minors may be exposed to a risk of injury or death while camping at WRR. I understand that significant medical costs, loss of income, or other financial damages may occur as a result of bodily injuries or death, and I agree to assume the financial obligations, either through my health insurance coverage or other means, that may result as a consequence of such injury, death, or damage.  Camper, guests, visitors and minors are voluntarily camping at WRR at their own risk.

  • Act within the limits of each guests’ abilities. There is still a risk of serious injury, including drowning.
  • Certain risks while camping include, but are not limited to, dangerous weather, insect bites, sunburn, heatstroke, dehydration, inadequate supervision, horseplay, carelessness, poor swimming skills, loss of personal articles and failure to wear personal floatation device.
  • Refrain from acting in any manner that may cause or contribute to the death, drowning or injury to himself or herself or to other guests/visitors while participating in camping or any activity at WRR.

Violations constitute negligence and, in this regard, it is impossible for WRR to guarantee absolute safety. As a participant in a recreation activity, I am responsible for acting within the limits of my ability and heeding all warnings regarding participation in the activity. I will maintain control of myself and any equipment while participating in the activity and will refrain from acting in any manner that may cause or contribute to injury to myself or to others. 

I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Wisconsin Riverside Resort, Inc., its owners and agents, from any and all liability to me, my children, my invitees/guests, personal representatives, and heirs for any loss or damage on account of injury to person (including death) or loss or damage to property relating to, or arising out of, use and occupancy of the Wisconsin Riverside Resort property, facilities, amenities, campground,  pools, and lagoon.  I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS Wisconsin Riverside Resort Management, and each of them, from any loss, liability, damage or cost (including attorney fees) they may incur due to injury (including death), damage or loss of property relating to use of the Premises by me, my children, and/or my invitees/guests or due to any incidents that may occur during my stay. I understand that, although Wisconsin Riverside Resort Management makes every reasonable effort to provide a secure environment, the security of my person, my belongings, and all persons registered in my party is my sole responsibility. 

The Premises are privately owned, and the Wisconsin Riverside Resort Management reserves the right to refuse service to anyone for any reason except for those prohibited by law. Wisconsin Riverside Resort Management reserves the right to ask any person or party it deems necessary, to leave the campground based on violations of Park Rules or behavior management deems inappropriate or disturbing to others. I have read this notice and agree to it as well as all Wisconsin Riverside Resort rules and regulations. In addition, I understand that I am responsible for the actions of all persons registered in my party, including any children, and any guests that visit during my stay. See Wis. Stats. 895.52

I have read and fully understand the above important information, warning of risk, assumption of risk and waiver and release of liability. If registering online, online signature shall substitute for and have the same legal effect as an original form signature.
